1. Who we are

MobiDesk is provided by Bith Agustine Atem Isaac, an individual trading as "MobiDesk" in Kenya ("we", "us"). When you use MobiDesk you are entering into an agreement with Bith Agustine Atem Isaac.

2. Accepting these terms

By creating an account or continuing to use MobiDesk, you agree to these terms. If you use MobiDesk for a business, you confirm you have authority to accept them for that business. You must be at least 18 years old.

3. The service

MobiDesk is online software that helps service businesses record customers, services, bookings, payments, balances, invoices and reminders, and offers a public booking page. WhatsApp messages are prepared for you to send yourself; MobiDesk does not send them automatically or collect M-Pesa payments for you.

4. Your account

• Keep your login details confidential. You are responsible for activity under your account.
• Provide accurate information and keep it up to date.

5. Acceptable use

You must not misuse MobiDesk. In particular you must not:

• use it for anything unlawful, fraudulent or to send spam;
• infringe anyone's intellectual property or privacy rights;
• upload malware, probe or test our security, scrape the service, or interfere with its operation;
• reverse engineer, resell or redistribute the service, or get around its technical limits.

6. Your content

You own the customer and business information you enter. You give us a limited permission to store and process it only to provide MobiDesk to you. You are responsible for having the right to store your customers' details.

7. Our intellectual property

We own MobiDesk, including its software, design, documentation and branding. We give you a limited, non-exclusive, non-transferable right to use it during your subscription or trial.

8. Plans, payment and the free trial

New businesses get a 14-day free trial with no card required. Paid plans are billed monthly. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals and cancellations are governed by Paddle's Buyer Terms. If you cancel, your plan stays active until the end of the period you paid for. See our Refund Policy.

9. Service level

We work to keep MobiDesk available and accurate, but we do not guarantee it will be uninterrupted or error-free. To the fullest extent allowed by law, the service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.

10. Suspension and termination

We may suspend or end your access if:

• you materially breach these terms;
• payment for your plan is not made;
• your use creates a security or fraud risk;
• you repeatedly or seriously break these terms.

You can stop using MobiDesk at any time. When your account ends, you can ask us to export or delete your data; we delete remaining data within a reasonable period.

11. Liability

We are not liable for indirect or consequential losses, such as lost profits, data or goodwill. Our total liability is limited to the fees you paid us in the 12 months before the claim. Nothing here limits liability for fraud, death or personal injury where the law does not allow it.

12. General

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction. We are not responsible for delays caused by events beyond our reasonable control. You may not transfer your account without our consent. We may update these terms and will show the new date above.
